She knows and doesn't agree with how he is handling things. In fact, she's quite fed up that he keeps taking off on dates or going to bed and leaving her to take care of Xander. She even had to feed him, make sure he was bathed and ready for bed when she was sick one night while John went to bed and left her with him.  

She has even told me the next time he just takes off and leaves Xander with her that she is going to bring him to me.

That's good that she's on your side. Is it just easier for your ex to leave your son with his mom than to drop him off at your place....perhaps a matter of being lazy?

Yes. He moved out of the house and is living with his mom. He would have to drive Xander over here for me to watch him if he already has Xander with him.  He doesn't want to spend the money on gas or drive over here so he just assumes his mom will take care of Xander and she has, but she's fed up.

I too am sorry you are going through this ... and I do agree he's an inconsiderate ass who also takes advantage of his own Mother.

One day your son will realize this ... until that day, I would take the higher road and do the best you can to keep some consistency in Xander's life.  I know you do not want to spend any more money on gaining custody ... and I also know it's pretty rare for a mom to lose custody ... so if you decided to, I'd bet you'd have a case to get full custody of him.  Good luck and thank God he's an EX ...
