This is it. Unless anyone else has something to add. Keep in mind the final file will have a b & w version, a black belt version, a navy belt version, a grey version for certificates as well. Imagine in the not too distant future TSD practioners getting together at an event with Dan pins, patches with this symbol not having to worry about prosecution AND the SBDMDK federation saving money, time and energy not having to peruse copyright infringement and putting that energy back into itself and growing. It's a win/win

Dan Segarra By the way this is completely designed by me and there was no clip art, copy pasting of any other images in any way and I have the original file to prove that. Some may draw similar to other logos but since all our fists look a like that cannot be avoided or copyrighted.

Alan Caponigro I like it and I think it is a good idea. I also think that if you leave an organization to go out on your own then why not create your own. That includes logo's-dan bon's-hyungs-ho sin sul-everything. I understand that people love the art and not the politics but at the present time you can not have one without the other. Someday maybe we can all be one happy family

Frank Clay I agree in principle. I don't see a need to completely re-write hyung because of leaving an organization unless they are proprietary OR you feel that improvements need to be made. Every SBN or KJN should have a robust enough skill set to give a student what they need. Sometimes you have to give them extra stuff to keep them growing.

David Sgro I also agree in principal, but not in all. I agree with the idea of logo, Dan Bon, Ho Sin Sul, but I still enjoy and practice my Hyungs. When Soo Bahk Do was still Tang Soo Do, Kwan Jang Nim Hwang Kee taught the Pyong Ahns, Nai Han Chi, Bassi, Kong Song Koon, etc. Those were not his creations. In adding the Yuk Rhos and the Chil Sung Hyungs he added to the art he created. Now for those who have created their own TSD system or Association there are folks who either want to continue teaching and training the Hyungs they learned, create their own or a combination of the two. I paid to learn all the material I was taught and at the time when I paid for the knowledge and was taught they Hyungs I was never told "If you leave the Federation you can't practice, teach, or create a video about this material." As such I still practice, teach and if i choose to make training materials for this training I will do so too. To me it's like going to a College, getting your degree and then you're told "You can use what you were taught because you are no longer with us". And while it's a nice thought that one day we'll be "one happy family", it will not happen until the Federation realizes that people grow and evolve, even to the point of being a Kwan Jang Nim. Let's use the example of my children: One day when my son starts a family it will be his family. He is part of, and will always be in my family and his children are my grandchildren, but they are HIS CHILDREN! He can continue to live in my house, with my rules, but chances are he will move into his own house and raise his family his own way. I can either dictate exactly how he will raise his family, which he may or may not want to do, or I can love him and watch his family grow and enjoy my time with him and his family. Chances are he'll keep many of the same traditions, and then he may change some too. There are leaders and there are followers. Kwan Jang Nim Hwang Kee was a leader, should it be a surprise that others followed in his steps to be leaders too? Why would a leader expect to create only followers? Is that even natural? Why would a family not want to create families within their families that they sanction and authorize? In my mind it was (and is) a critical mistake. If we really want to be one big happy family we have to let folks grow to their potential. My plan for my Association is that I want my students to out grow me. I want them to grow to their potential, regardless if they stay within my system or one day create their own. That is up to them and regardless of the way they go I will want to support them in any way I can. That's why we (KJN Steven Voelker) and I co-founded the US Goodwill Association; so as to allow folks to be part of an Association yet develop their system as they see fit. One can only imagine the strength SBD/TSD would/could be if we learned to work as one family. It's sad to see how things are progressing in the negative aspects of things, yet it's also very exciting to see how some groups and Associations are going and growing. Many of the senior Nationals leaders are quite senior now. Many National Leaders have 35 - 50 (or more) years in the Arts! I wold love to see us learn to work together!

Alan Caponigro KJN Sgro-I am doing just fine thanks for asking. I hope you are doing well also. I understand your points and wondered the same about the other forms as well. Just about every style of karate have some form of Pyong Ahns-Nai Han Chi-Passai-and so on but nobody seems to care about who does thoses forms.I guess there is no easy answer.

David Sgro ‎"Cap"! Good to hear from you! I can understand the position about a registered TM (ie MDK name, flag etc) but Hyungs that were taught are not something I believe should be included in this criteria. But I was glad to see you resumed your training and I have fond memories of the Federation and our ties competing at Nationals in the late 70's, 80's, and early 90's!

Charles Ferraro Good Afternoon Gentlemen...interesting conversation. I would add that you can not trademark movements. Correography can be trademarked...but they again how easy is it to slightly change correography and thus create a new trademark. Remember correography is inclusive of movements, music, surroundings, etc. Written by Susan Neuberger Weller

The U.S. Copyright Office has made it clear through a Statement of Policy released on June 18, 2012 that “functional physical movements such as sports movements, exercises, and other ordinary motor activities alone” are not works of authorship protected under U.S. copyright law. The Statement was issued to clarify the practice of the Office relating to examination of claims of compilations involving uncopyrightable subject matter, and also to clarify the Office’s policy with respect to registration of choreographic works. The Office also distinguished between copyrightable “choreography” and yoga or exercise positions or other physical movements. Legislative history indicates that “choreography” does not include “social dance steps and simple routines.” The Statement states that “although a choreographic work, such as a ballet or abstract modern dance” incorporate “simple routines, social dances, or even exercise routines as elements of the overall work, the mere selection and arrangement of physical movements does not in itself support a claim of choreographic authorship.” Rather, it is explained that such a work must contain “at least a minimum amount of original choreographic authorship,” which for copyright purposes must be a “composition and arrangement of a related series of dance movements and patterns organized into an integrated, coherent, and expressive [compositional] whole.”

The bottom line is that no one in the U.S. can claim rights exclusive to the rest of the world in yoga routines, exercise positions, sports movements, simple dance steps, or other simple, functional, physical activity. So, feel free to express yourself in any manner you see fit next time you are on the dance floor, in a yoga studio, in an exercise class or just skipping down the middle of the street at midnight … knowing there’s nothing in the copyright law (at least) to stop you. http://www.law.cornell.edu/uscode/text/17/102
